Marriage of Baylocq and Wilberding
Appellant Monique Baylocq Wilberding[1] sought under Family Code section 2030[2] attorney fees and costs incurred during proceedings for the dissolution of her marriage to respondent Thomas A. Wilberding, Jr. Thomas sought attorney fees and costs under section 2030 and as a sanction under section 271. The trial court denied attorney fees and costs to either party under section 2030 but awarded $4,000 to Thomas under section 271 as a sanction. Monique timely appeals the denial of her request for attorney fees and costs. Monique claims that the trial court abused its discretion when it denied her fee request because it ignored a substantial disparity in income between her and Thomas, and did not consider Moniques section 2030 request separately from Thomass request for section 271 sanctions. Monique does not appeal the section 271 sanction award. Court conclude that Monique is unable to demonstrate that the trial court abused its discretion when it denied her attorney fees and costs. Therefore, Court affirm.
