Hauselt v. County of Butte
Plaintiff William Hauselt sued Butte County (the County) for inverse condemnation and related torts. He brings this appeal objecting to the trial courts award of attorney fees and costs under Code of Civil Procedure section 1036 (section 1036). After a lengthy court trial, plaintiff prevailed on only one of his claims. A judgment was entered awarding plaintiff $1,034 as just compensation for a temporary taking by the County of an easement on plaintiffs property. Plaintiff subsequently filed a memorandum of costs seeking $414,103.49 in attorney fees, and a variety of other costs, fees and expenses pursuant to section 1036. The County filed a motion to tax costs, which the trial court granted in part and denied in part. The trial court awarded plaintiff a total of $45,039.10 for attorney fees and other costs. Plaintiff appeals contending the trial court abused its discretion in making the award. Court affirm the judgment.
