P. v. Romero
Salvio Romero appeals the judgment entered after a jury convicted him on two counts of indecent exposure with a prior (Pen. Code,[1] 314, subd. (1)). The jury also found true allegations that Romero had served three prior prison terms ( 667. 5, subd. (b)). The trial court sentenced him to a total state prison term of six years eight months. He contends (1) the court abused its discretion in admitting evidence of his prior convictions for violations of sections 288 and 288a pursuant to Evidence Code section 1108, and (2) the court erred in denying his request to represent himself at the sentencing hearing and in refusing to consider his motion for a new trial. Although we agree the court erred in admitting the prior convictions, the error was harmless. Court affirm.
