P. v. Cariglio
In case No. FCR235651, a jury convicted defendant James Jarold Cariglio (appellant) of committing a lewd act upon a child under the age of 14 years (Pen. Code, 288, subd. (a)). After appellants motion for a new trial was denied, he was sentenced to six years in state prison with credit for time served of 680 days. Appellant filed a timely appeal.[1]

Appellant contends the trial court erred in excluding third party culpability evidence and denying his motion for a new trial. Appellant further argues his trial counsels failure to prepare and present third party culpability evidence deprived him of effective assistance of counsel. Court reject appellants contentions and affirm the judgment.
