P. v. Wilkerson
While working at a hotel, Mark C. Wilkerson took a guest's credit card and used it to make unauthorized purchases. A jury convicted him of two counts of using personal identifying information of another (counts 1 and 3; Pen. Code, § 530.5, subd. (a)) and one count of second degree burglary (count 2; § 459). He admitted to two prison priors and probation denial priors. (§§ 667.5, subd. (b), 668, 1203, subd. (e)(4).) The superior court sentenced Wilkerson to a split term of five years eight months, with Wilkerson serving the first four years in county jail and the remaining one year eight months under mandatory supervision.
