Bishara v. Rite Aid CA2/5
Plaintiff and appellant Saad Bishara appeals from a judgment of dismissal following an order granting summary judgment in favor of defendants and respondents Rite Aid Corporation, Rite Aid Payroll Management, Inc., Thrifty Payless, Inc., Kert Patal, Rehana Mustafa, and Ahlet Hii in this wrongful termination action. On appeal, Bishara contends triable issues of fact exist as to: 1) discrimination based on his age or having taken medical leave, including whether Bishara was satisfactorily performing his job at the time of his termination; 2) harassment based on his age and having taken medical leave; 3) retaliation; and 4) wrongful termination in violation of public policy. We conclude there was no direct evidence that Bishara was terminated as a result of prohibited discrimination.
