P. v. Salmeron CA2/7
Leonardo Salmeron was convicted of kidnapping to commit robbery (Pen. Code, § 209, subd. (b)(1)) and second degree robbery (§ 211). He challenges his robbery conviction on the ground that the trial court failed to give an instruction sua sponte on attempted robbery as a lesser included offense of robbery. We affirm the judgment.
