P. v. Fontenot CA4/1
A jury convicted Jose Luis Lopes Fontenot of the first degree murder of his stepfather, J.H., in 2011, and it found true the allegation that he intentionally and personally used a firearm in the commission of the crime. (Pen. Code, §§ 187, subd. (a); 12022.53, subd. (d); count 1.) A jury also convicted Fontenot of second degree murder and found true the allegation that he intentionally and personally used a firearm in the commission of the 2009 murder of G.B. (§§ 187, subd. (a); 12022.53, subd. (d); count 2.) He was a juvenile when he committed the crime. The trial court sentenced Fontenot to life without the possibility of parole for the first degree murder conviction (count 1), then 25 years to life consecutively for the firearm enhancement. It stayed a sentence of 15 years to life for the second degree murder conviction (count 2), but imposed 25 years to life consecutively for the firearm enhancement.
