In an information filed by the Los Angeles County District Attorney’s Office, defendant and appellant Wayne Dinsmore Gray was charged with three counts of murder (Pen. Code, § 187, subd. (a); counts 1-3) and one count of possession of a firearm by a felon (§ 29800, subd. (a)(1); count 5). As to counts 1 through 3, it was alleged that defendant used and personally and intentionally discharged a handgun (§ 12022.53, subds. (b)-(d)), a principal used and personally and intentionally discharged a handgun (§ 12022.53, subds. (b)-(e)), and the murders were committed for the benefit of, at the direction of, and in association with a criminal street gang with the specific intent to promote, further, and assist criminal conduct by gang members (§ 186.22, subds.
