P. v. Runkle CA4/2
On October 13, 2021, an amended felony complaint charged defendant and appellant Cristian Runkle, and codefendants Merlin Perales Ortiz and Isaiah Rodriguez, with murder under Penal Code section 187, subdivision (a) (count 1).
On October 20, 2021, pursuant to a negotiated disposition, defendant pled guilty to second degree murder and the trial court sentenced him to 15 years in prison. Defendant executed a plea waiver form, was advised of and waived his constitutional rights, and stipulated to a factual basis for his plea.
On November 3, 2021, defendant filed a timely notice of appeal. Defendant stated that his appeal was based on “the sentence or other matters occurring after the plea that do not affect the validity of the plea.” Defendant also filed a request for a certificate of probable cause; the court denied the request.
