In re Elizabeth C. CA5
Initial Petition and Detention
On January 14, 2020, the Kern County Department of Human Services (department) filed a petition on behalf of one-month-old Elizabeth and her three siblings pursuant to section 300, subdivision (b)(1)–(3) alleging she had suffered, or was at substantial risk of suffering, serious physical harm or illness due to the parents’ failure to protect her. Mother had a history of substance abuse and had used methadone and heroin while pregnant with Elizabeth. Although father knew of mother’s substance abuse, he allowed her to be the children’s primary caretaker.
On January 15, 2020, at the detention hearing, the juvenile court ordered Elizabeth detained and granted mother and father supervised visits two times a week for two hours.
Jurisdiction and Disposition
On January 16, 2020, mother and father had their first supervised visit. They had two additional visits in February 2020. The department reported mother and father visited consistently.
